II. Purpose
These general terms and conditions of sale are intended to inform potential buyers of the terms and conditions under which the Seller proceeds with the sale and delivery of the products ordered, and to define the rights and obligations of each of the parties in the framework of a sale of products by the Seller to the Buyer.
They apply automatically to all sales made by the company PLANTIN SAS (a limited company with capital of EUR 1,000,000.00 and its registered office located at Route de Nyons - 84110 Puymeras, France, and registered with the Avignon Trade and Companies Register under number 706 920 212, identified under intra-community VAT number FR81706920212) to any consumer or legal entity purchasing for needs other than those relating to their professional activity any product on sale in Plantin’s online store on its website www.truffe-plantin.com, having agreed to fill in the mandatory fields presented at the time of registration and having a delivery address located in one of the geographical areas served by Plantin.
Confirmation by the customer of an order submitted via the website implies full and complete acceptance of these general terms and conditions of sale and of the special terms of the order.
Any order implies unreserved acceptance of these general terms and conditions of sale, which shall prevail over all other terms and conditions, except those expressly accepted by Plantin. Plantin reserves the right to amend the general terms and conditions of sale at any time. In that case, the applicable conditions shall be those in force on the date of the Buyer’s order.
III. Products
Each product offered on the website is the subject of a precise description of its main characteristics and its price.
Prior to placing an order, Buyers can therefore review the essential characteristics of the product(s) that they wish to order via the Plantin website.
The photographs illustrating the products are not contractual and are merely provided as an indication of the general presentation of the products.
IV. Validity of the product offering
The product offering remains valid while stocks last.
In the event that a product becomes unavailable after the order is placed, the Buyer will be informed by email or telephone within 24 hours (working day) of the order.
They may then either choose to:
- postpone delivery until the product is restocked, where this is possible,
- exchange the missing product for another, equivalent in quality and price,
- cancel the order and be refunded for the price paid.
V. Formation of the contract – Orders
Website access
The Plantin website is accessed at www.truffe-plantin.com The Buyer shall be personally responsible for establishing access to the IT and telecommunications resources required to browse the Plantin website.
The Buyer shall bear the telecommunication costs for accessing the Internet and using the website.
Login
When placing their first order, the Buyer is required to create a personal account on the Plantin website.
To do so, the Buyer shall enter an email address (used as their user ID), a password and the following information: First name and surname – Address (building number/letter and street) – Town/City – Postcode – Country and telephone number. This information is used for all subsequent orders and helps us provide the most personalised follow-up possible.
The password chosen by the customer, used together with the email address indicated (used as their user ID), is proof of identity and commitment to any order they place. They have the status of electronic signature within the meaning of the French law dated 13 March 2000. The customer is solely responsible for their login and password and shall bear the consequences that may result from their use by any third parties that become aware of them.
Ordering
To place an order, the Buyer selects each product they wish to order after consulting the essential characteristics set out in the product descriptions, then clicks on “Add to cart”.
Once they have selected the products and quantities, the Buyer can enter a discount code if they have one. They will then click on “Place the order” to confirm their selection.
The customer will then select the delivery address and delivery method before proceeding to payment in accordance with the conditions provided and confirming their order and payment.
All data provided by the Buyer are binding on the latter. In the event of an error by the customer in their details or those of the place of delivery, in particular their surname, first name, address, telephone number, email address or door code, resulting in the loss of the products, the customer shall remain liable for payment of the lost products and no refunds shall be made.
Plantin will confirm the Buyer’s order by email.
VI. Payment – Prices
The prices of each product on sale on the Plantin website are stated in Euros, inclusive of all taxes, and are the prices in force at the time the Buyer places the order, plus delivery costs.
Orders are payable in cash, in Euros. Payment shall be made by the Buyer at the time of their order.
Payments shall be made online using a banker’s card (Carte Bleue, Visa, Eurocard Mastercard or AMEX) via the Paybox 3D Secure system.
The order shall not be dispatched until full payment for the goods plus shipment has been received.
Delivery of the order may be suspended or cancelled in the event of the Buyer’s failure to pay the amount due or in the event of a payment incident.
VII. Delivery
At the time of their order the Buyer is asked to indicate the delivery address for their order. If the billing address is different from the delivery address, the Buyer should indicate this.
The online sale of the products presented on the Plantin website is applicable for deliveries to mainland France, Corsica, Germany, Austria, Belgium, Denmark, Spain, Finland, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, the United Kingdom and Sweden.
Plantin undertakes to process all orders as quickly as possible (within 72 hours).
Orders are processed from Monday to Friday, subject to product availability.
Delivery costs are calculated automatically when the order is placed and appear on the page indicating the total cost of the order, before the order is confirmed for good.
The Buyer selects their choice of carrier when finalising the order.
For orders containing fresh products: the preparation of orders for fresh products requires special packaging to ensure that the product is kept at the required temperature until delivery. For all orders containing fresh truffles, delivery will be made by express refrigerated transport.
In case of absence, the Buyer or the recipient of the ordered product receives a calling card with the information they require to contact the carrier to pick up their parcel(s). They will need to pick up their order within 24 working hours due to the perishable nature of the product(s).
The Buyer shall be responsible for providing the recipient’s name and address (door code, floor, telephone number, etc.) to enable delivery under normal conditions, and to avoid any delay or problem in delivery, which could result in additional delivery costs to be borne by the Buyer.
P.O. Box delivery addresses will not be accepted.
The Buyer is delivered to their home and signs the delivery slip (in the case of a Chronopost shipment). The Buyer shall check the condition and number of parcels delivered in the presence of the delivery person.
In the event of missing items, damage or any other anomaly, the customer shall write down their reservations on the delivery note on receipt of the package. If this clause is not respected, it will not be possible to open a refund procedure with the carrier.
If items are missing from the package, the Buyer must inform us within 24 hours of delivery.
The Buyer shall not be entitled to claim damages, to withhold payment or cancel the order in the event that the delivery time is exceeded.
Plantin shall in no event be liable for any deterioration of the products due to the late receipt of a parcel owing to the absence of the customer or the person authorised to receive it.
VIII. Right of withdrawal
For all products, with the exception of fresh items, and in accordance with Article L. 121-20 of the French Consumer Code, the Buyer has a period of fourteen clear days from the date of receipt to return the ordered products, at their own expense, for a refund.
All orders shall be honoured within the limits of available stocks. In the event of unavailability of products after the Buyer has placed their order, Plantin undertakes to notify the Buyer by email as quickly as possible. The Buyer may then request the cancellation of their order or request an exchange of the unavailable products.
Products must be returned to Plantin in perfect condition for resale, in their original state (packaging, accessories, instructions, etc.), duly sealed.
IX. Liability
The Seller shall not be considered liable or in default for any delay or non-performance attributable either from the consumer, or to the unforeseeable and unpreventable act of a third party to the contract, or to a case of force majeure as generally recognised by French case law. War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the Seller from his obligation to deliver.
The Seller shall not be held liable for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, disruption of service or other unforeseen issues.
X. Data Protection and Civil Liberties
The data collected by Plantin at the time the Buyer places an order are required for Plantin to process the order. In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, the Buyer has the right to access, rectify, oppose and delete data concerning them by sending an email to info@plantin.com
Plantin may inform Buyers of special offers. If the Buyer does not wish to receive this kind of promotional correspondence, they may inform Plantin by post or email – see the “Contact” page.
In accordance with French law n° 78/17 of 6 January 1978 relating to data processing, files and freedoms, the site www.truffe-plantin.com has been declared to the CNIL.
XI. Settlement of disputes
These general terms and conditions of online sales are subject to French law.
In the event of a dispute, jurisdiction is attributed to the competent courts under the conditions of common law and, in the event of a dispute with professionals and/or traders, to the courts of Avignon, notwithstanding multiple defendants or the introduction of third parties.
